NOTICE OF PRIVACY PRACTICES

Not all services provided by Corporate Health Solutions (CorpHealth) require or establish a doctor-patient relationship. Some services such as independent medical examinations expressly do not establish a doctor-patient relationship.

This notice describes how medical information may be used and disclosed and how an individual serviced by CorpHealth may obtain access to this information. Please review carefully.

PROTECTED HEALTH INFORMATION. hereafter noted as PHI, is information including demographic or billing information that may individually identify a person who has received a service from CorpHealth that relates to present, past or future conditions and related health care delivery and payment.

This is a formal notice, as required by law, explaining how we may use and disclose PHI to carry out treatment (if applicable), to obtain payment (if applicable), to maintain health care operations and for other purposes as permitted by law. It also describes rights of access and control of PHI.

HOW WE MAY USE AND DISCLOSE PHI

Not all services provided by CorpHealth involve the formulation of specific treatment recommendations with respect to an individual receiving service. Some services, such as independent medical examinations, may or may not involve formulation of treatment recommendations as requested by the referring entity. If applicable, appropriate and subject to our discretion, we may use PHI to provide, coordinate and/or manage health care and any related services. This includes, but is not limited to, communication with other physicians and providers, nurses, technicians, office staff, specialists, laboratories, pharmacies and imaging centers.

Subject to our professional discretion and if applicable, we may use PHI to obtain payment for services provided by CorpHealth from the appropriate individual responsible for payment. It is understood that obtaining payment may require the reasonable use of additional parties including but not limited to legal counsel and collection agencies.

We may use or disclose PHI in order to support our business activities. These activities include but are not limited to profession peer review, employee activities, internal audits, training, education, accreditation, insurance or licensing activities.

We may contact an individual as a reminder that that individual has an appointment for a service from CorpHealth. We may initiate contact as related to service already rendered. Persons serviced by CorpHealth have the right to request and CorpHealth will attempt to accommodate reasonable requests to receive communications regarding PHI by alternative locations.

We may share PHI with additional "business associate" parties that provide various services for us.

Unless requested otherwise, we may at our discretion, disclose PHI to relatives, friends or any other person identified by an individual receiving service from CorpHealth that directly relates to that relative, friend or person's involvement with the individual receiving service.

Consent is not required before using or disclosing PHI in an emergency situation.

We may disclose PHI as required by and in a manner consistent with federal, state or local laws. We may disclose PHI as required by health oversight agencies. We may disclose PHI in the course of any judicial or administrative proceeding. We may disclose PHI as requested by a law enforcement official, subject to all applicable legal requirements. We may disclose PHI to comply with workers' compensation law.

We may disclose PHI to coroners, medical examiners and funeral directors to establish such parties to perform their duties as appropriately and duly authorized. We may disclose PHI as legally permitted to do so if there is a reason to believe that this information is necessary to prevent or lesson a serious and imminent threat to the health and safety of a person or the general public. Subject to all applicable legal requirements, we may disclose PHI of individuals who are or were members of the armed forces, national security or intelligence communities if requested by an appropriate authority. We may disclose PHI to researchers with projects duly approved by an institutional review board charged with assuring protection of privacy. An individual receiving service from CorpHealth may revoke consent to use PHI by providing CorpHealth with written notice. Such revocation, once received, will not apply to required disclosures and will not apply to permitted disclosures as described above.

An individual receiving service from CorpHealth may have the right to inspect and copy PHI. Such requests must be made in a manner consistent with company policies and may involve the assessment of a reasonable fee. If PHI cannot be released due to an applicable statute, a requesting individual is entitled to a written explanation. Subject to all applicable legal and administrative requirements, an individual receiving service from CorpHealth may request limits on the use and disclosure of PHI. Subject to all applicable legal and administrative requirements, an individual receiving service from CorpHealth may have the right to amend PHI. Such requests for amendments must be submitted in writing using the appropriate form. Such requests for amendments may be denied if not submitted in writing and/or do not include supportive reasoning. Such requests can only be made with regard to information created by CorpHealth. An individual receiving service from CorpHealth is entitled to an accounting of certain disclosures. In exchange for such accounting, a reasonable fee may be assessed. This right to an accounting does not extend to disclosures related to treatment, payment or health care operations. An individual receiving service from CorpHealth is entitled to a copy of this notice at any time.

CHANGES TO THIS NOTICE/COMPLAINTS

CorpHealth reserves the right to withdraw from, modify or change this notice at any time and to make any revisions applicable to PHI already in possession of CorpHealth. Notice in the event of a withdrawal from this notice will be posted to all affected parties within 60 days of the revision. Complaints regarding privacy rights can be filed in writing to the privacy officer of CorpHealth. Complaints may also be filed with the Secretary of Health and Human Services.
